Terms and conditions
The company HALO CONCEPT SAS is active in the creation, production and commercial operation of a merchant website, including sales and back-office activities, in its name on behalf of its customers, as well as the associated activities such as promoting this website and promoting the products sold.
HALO CONCEPT SAS is responsible for the creation and management of the website www.haloconcept.com (hereinafter “the Site”);
These General Conditions of Sale are intended to define the rules applicable in the context of the sale of products (hereinafter "the Product(s)") on the Site,
HALO CONCEPT SAS. (hereinafter "HALO CONCEPT SAS"),
whose head office is located at 732 chemin des colles, 06740 Chateauneuf, France
Any adult natural person, non-commercial, having the legal capacity to contract, exclusively domiciled in the countries delivered by www.haloconcept.com (hereinafter "the Customer") making a purchase of Product
on the site.
For the application hereof, it is agreed that the Client and HALO CONCEPT SAS. will be collectively referred to as
the “Parties” and individually referred to as the “Party”.
These general conditions (hereinafter the "General Conditions of Sale") govern without restriction the sales of Products by HALO CONCEPT SAS. from the Site.
HALO CONCEPT SAS. reserves the right to modify these General Conditions of Sale at any time by publishing a new version on the Site. The applicable General Terms and Conditions of Sale are those in force on the site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full and complete acceptance of the General Conditions of Sale in force at the time of placing the order.
ARTICLE 1: OBJECT
The purpose of these General Conditions of Sale is to define the conditions under which the Products are marketed by HALO CONCEPT SAS. to the client. They thus regulate the different stages of the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.
ARTICLE 2. PRODUCTS
The Products offered for sale by HALO CONCEPT SAS. are those appearing on the site on the day of its consultation by the Customer; it being specified that the photographs illustrating the Products are not contractual. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the sizes, the composition, as well as the particular characteristics.
HALO CONCEPT SAS. undertakes to deliver Products that meet the requirements in force relating to the safety and health of persons in accordance with European provisions, and in particular the legislation on regulated chemical substances.
ARTICLE 3. PRICE
The prices are indicated in euros all taxes included, excluding delivery costs; it being specified that the value added tax is that in force on French territory on the day of validation of the order.
The prices applied are those communicated on the Site and confirmed to the Customer during the validation of the order.
The delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed all taxes included. These costs are the responsibility of the Customer and are invoiced in addition
the selling price of the Products.
The transfer of the risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Customer.
ARTICLE 4. ORDERING AND PAYMENT OF PRODUCTS
The Customer materializes his order by completing the following 5 steps
Step 1: the Customer selects the chosen Products and adds them to his basket after having selected (if applicable) the desired color.
The basket located at the top right of the screen informs the Customer that he has taken the selections into account by indicating the number of Products it contains.
Step 2: the Customer checks the contents of his basket by clicking on “order” in order to have access to the summary of his order. The Customer can then modify his order (Product, color, quantity).
The total amount including VAT of the order, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary.
Step 3: Once the order has been verified and modified if necessary, the Customer validates his basket in order to finalize his order by clicking again on “order”.
If the Customer has an advantage code, reserved for the best Customers, he must enter it in the space provided for this purpose in order to benefit from it.
Step 4: Entry by the Customer of the delivery and billing details
Fields marked with an asterisk (*) are required fields; it being specified that unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address.
If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will only identify himself with his email address and password.
The Customer then verifies all the information and clicks on "validate" to continue with his order.
Step 5: Enter bank details
The Customer will then access the secure payment screen of the partner of HALO CONCEPT SAS. as specified in article
Payment is made online by credit card or paypal account.
The Customer must connect to his paypal account or must enter his bank card number, its expiry date as well as the 3 numbers of the visual cryptogram present on the back of his card, it being specified that in the event of payment by
American Express card, the Customer must provide 4 digits.
If the payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.
In the event of payment failure, the Customer will have up to 3 attempts to re-enter their bank details. At the end of the 3rd refusal, the Customer will be redirected on the Site to a screen indicating the refusal of payment. The Customer will then be invited to contact HALO CONCEPT SAS customer service. to find out the reasons and together find a solution to finalize the Customer's order.
4.2 - Confirmation of the order
Upon acceptance of the Customer's payment, the Customer will receive an e-mail confirming his order, summarizing all the items ordered, the billing and delivery address and the estimated delivery date.
The validation of the order by the Customer and the order confirmation sent to the Customer by e-mail by HALO CONCEPT SAS. following the acceptance of the payment are worth conclusion of a sales contract between the Parties and acceptance of the General Conditions of Sale.
The Customer who has placed an order will be able to print his invoice by connecting to the Site in the order tracking space provided for this purpose.
HALO CONCEPT SAS. reserves the right not to validate the order in the event of:
• abnormal or abusive complaints,
• abnormal orders with regard to the quantities ordered,
• abnormal or abusive exchanges and returns,
• existing dispute(s) with the customer.
The site's customer service department is available to the Customer for any questions relating to their order.
Customer service is available by email (email@example.com).
4.3 - Payment
The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer.
Payment is made online by paypal or by credit card (Carte Bleue, Visa, Eurocard/Mastercard) at the time of validation of the order by the Customer.
The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. HALO CONCEPT SAS. reserves the right to make a new
direct debit authorization request in the event that the first could not be completed due to the unavailability of the servers.
In the event of a payment default, an incorrect address or any other problem on the Customer's account, HALO CONCEPT SAS. reserves the right to block the Customer's order until the problem is resolved.
HALO CONCEPT SAS. disclaims all liability in the event of fraudulent use of a Customer's bank card on the Site. This data cannot be detected, intercepted or used by third parties. At no time does the Customer's financial data pass through the HALO CONCEPT SAS computer system.
4.4 – Archiving of the order
The order confirmation is recorded in the registers of HALO CONCEPT SAS. , themselves stored on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.
ARTICLE 5. DELIVERY
HALO CONCEPT SAS. will do its best to ensure that the order accompanied by a delivery note (subject to full payment and collection of the order) is delivered within an average of three (3 to 5) working days in metropolitan France (including Corsica ) and in Monaco. European Union countries will be delivered within an average of four (4) to seven (7) working days
Any product acquired on the site will be delivered within a maximum period of thirty (30) working days from the day following payment of the order to the address indicated by the Customer when ordering on the Site.
In the event of exceeding the delivery time, not justified by a case of force majeure, the Customer may request the resolution of the sale and obtain within a maximum period of 30 (thirty) days the reimbursement of the sums paid to
the occasion of the sale.
For orders outside France, when the package intended for export reaches its destination, it will be the recipient's responsibility to pay the taxes or customs duties that apply to the country of destination. Local authorities can provide you with useful information.
ARTICLE 6: RECEIPT OF THE ORDER - COMPLAINTS -
The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery.
Any anomaly concerning the delivery such as:
• damaged package,
• Missing products,
• Damaged products,
• Products not conforming to the order,
must be notified within fifteen (15) working days following receipt of the order.
This notification will be sent to the site's customer service either:
- By registered mail, by writing to the following address: HALO CONCEPT SAS
- By e-mail to firstname.lastname@example.org
After this period, and except for hidden defects, no complaint will be accepted by HALO CONCEPT SAS., the Products then being deemed to be compliant.
For any return of non-compliant Product, the Customer must comply with the following procedure:
• the Customer must attach to his package the return slip issued by HALO CONCEPT SAS.
• the Products must be returned in their original packaging, with their label and any accessories, in perfect condition to HALO CONCEPT SAS
- The risks and costs of return are the sole responsibility of the Customer.
When non-compliance has been noted, HALO CONCEPT SAS. will offer the Client either:
• the replacement of the Product(s) at the expense of HALO CONCEPT SAS., either
• reimbursement of the price of the order (price of the Products and delivery costs) as well as the costs of returning the non-compliant Product, at the latest within thirty (30) days from the date of dispatch of the notification confirmation of non-compliance by the site's customer service.
In the event of a refund, HALO CONCEPT will ensure the refund of all the products made compliant, as well as the shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery.
Cash on delivery returns are not accepted. Upon receipt of a non-compliant item, HALO CONCEPT covers the reimbursement of return postage costs up to the price list (Colissimo delivery without registered mail) displayed by La Poste on March 1 of the current year. The Customer must send proof of the return costs incurred to Customer Service, by email or by post.
In the event of abnormal or abusive complaints, HALO CONCEPT SAS. may refuse to serve a subsequent order.
ARTICLE 7. RIGHT OF WITHDRAWAL
The Customer has a period of fifteen (15) working days from the date of receipt of his order to return the Products ordered, without justification or penalty.
For any return under the right of withdrawal, the procedure below must be fully respected:
• the Customer must attach to his package the voucher issued by HALO CONCEPT SAS.
• the Products must be returned in their original packaging, with their label and any accessories, in perfect condition to HALO CONCEPT SAS.
• The risks and costs of return are the sole responsibility of the Customer.
Subject to the conditions mentioned above, HALO CONCEPT SAS. will reimburse the amount including VAT of the order to the Customer (price of the Product and delivery costs) excluding return costs. The Customer's bank account will be credited with said amount, within thirty (30) days of receipt of the Products by HALO CONCEPT SAS.
ARTICLE 8 – PERSONAL DATA
HALO CONCEPT SAS. collects a certain amount of information necessary to process orders.
These data are not only necessary for the processing of the Customer's order by HALO CONCEPT SAS., but also to communicate to the Customer information on the site or to allow him to benefit
commercial offers; if the Customer accepts it when creating his account.
The information is strictly confidential and is indicated by an asterisk (*) when it is necessary for HALO CONCEPT SAS., and/or its service providers in the context of the management of the Customer's order.
Following any injunction from the legal authorities or in order to defend its rights or those of its employees, customers or any other person, HALO CONCEPT SAS. may communicate this data to bodies and authorities legally
HALO CONCEPT SAS. undertakes to take all useful precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer's personal information from being
deformed, damaged or that unauthorized third parties have access to it.
The Customer's personal information is sent to and stored at the site host located in France, whose contact details appear on the site under the heading “Legal Notices”.
SECTION 9. COOKIES

ARTICLE 10. LIMITATION OF LIABILITY
Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, particularly with regard to technical performance, response times, connection times, queries or information transfers, the risks of cut, the risks of contamination by viruses circulating on the network and in general all the risks related to the use of the Internet network.
HALO CONCEPT SAS. can therefore under no circumstances be held liable for any direct or indirect damage resulting from misuse or incident related to the use of the computer, access to the Internet, maintenance or
malfunction of the servers, the telephone line or any other technical connection, the Customer's connection to the Site being made under his full responsibility.
ARTICLE 11. FORCE MAJEURE
HALO CONCEPT SAS. will not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if this non-performance is caused by an event constituting a case of force majeure as defined by positive law .
In such a case, HALO CONCEPT SAS. will inform the Customer of the occurrence of such an event within 3 (three) clear days following its occurrence, by e-mail.
After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be canceled and will, if necessary, be reimbursed by HALO CONCEPT SAS. on the map
bank used to place the order within a maximum of 30 (thirty) days.
ARTICLE 12. APPLICABLE LAW
If any of the terms of these General Terms and Conditions of Sale were found to be null, illegal or unenforceable by a court decision, the other provisions of the General Terms and Conditions of Sale will remain in force.
The General Conditions of Sale are executed and interpreted in accordance with French law.
In the event of a dispute, the customer should first contact HALO CONCEPT SAS. to obtain an amicable solution and in the absence of an agreement, the Courts of Grasse, France will have sole jurisdiction.
